Edward Smith represents clients in complex commercial, environmental, and bankruptcy matters, with a practice covering litigation, including restructuring litigation. He advises businesses and governmental entities on high-value litigation and disputes, insolvency proceedings, and regulatory compliance, drawing on extensive courtroom experience gained from decades in both public service and private practice.

Edward’s recent work includes arbitrating a multi-million dollar dispute arising from a multi-national’s acquisition of a skin care company. He has also represented New York’s largest healthcare provider in litigation resulting from the COVID pandemic. Edward also serves as the receiver in a commercial mortgage foreclosure involving a boutique Manhattan hotel, managing all aspects of operations. Serving as the attorney for the Village of Pelham, New York, he has represented the municipality in litigation and advised on a significant public-private development project as well as on governance, contracts, and statutory compliance. His practice also extends to environmental law, where he has handled litigation and counseled government entities on CERCLA cost recovery actions and Superfund site issues.

Before joining Broadfield, Edward worked at several major New York law firms, including Venable LLP and Cadwalader, Wickersham & Taft LLP. Earlier in his career, he was an Assistant U.S. Attorney in the Southern District of New York, serving for a decade and eventually leading both the Tax and Bankruptcy Unit and the Environmental Protection Unit.

  • Represented the foreign representative Switzerland-based Lehman Brothers Finance S.A. under Chapter 15 of the Bankruptcy Code in U.S. litigation against a major New York financial institution.
  • Represented counterparties to derivatives contracts in the Chapter 11 proceedings of Lehman Holdings.
  • Representing Enron Corp. in its Chapter 11 proceedings, including prosecution of more than 30 fraudulent conveyance actions, as well as serving as lead counsel for Enron in litigation (including first-chair in a trial) against a Fortune 100 oil company arising from a joint-venture involving an interstate natural gas pipeline.
  • Handled commercial mortgage-backed securities (CMBS) litigation and commercial mortgage foreclosures and advised special servicers in connection with defaulted commercial mortgages.
  • Served as lead counsel for a municipality in connection a significant public-private redevelopment project.
  • Served as lead counsel for the County of Westchester in a CERCLA cost recovery contribution action involving a contaminated environmental site.
  • Represented Chapter 11 bankruptcy trustee in all aspects of involuntary bankruptcy cases and related litigation resulting from a multi-million dollar Ponzi scheme.
