The Law Society produced a revised TA6 form, expecting that estate agents would seek advice from solicitors, structural engineers and planning specialists when dealing with material information rules.
In an article for Estate Agent Today, partner Tim Middleton outlines why the updated form should be scrapped.
“Most solicitors do not want or believe the updated TA6 is needed, because it leaves them trying to advise on potential issues they have no control over, whilst adding further cost and delay that nobody wants. Estate agents don’t want it, since they fear anything which has the potential to delay transactions more than they already are. Nor is there any evidence that buyers or sellers want it either.”
